Your Personal Information

Where you provide personal information to Facility ERP Pty Ltd it will be used only for the service you requested.

Facility ERP Pty Ltd does not automatically capture or store personal data from visitors to the site, except to log the user's IP address and session information such as the duration of the visit to the site and the nature of the browser used. This information is used only for administration of the site system and in the compilation of statistics used by Facility ERP to assess the use of the site.

Your information will only be captured and stored if you have submitted an online form requesting to download content or have requested further information.


How Your Information Will Be Used

- By using the website, you agree that we may use your information (including personal information) for the purposes of:

- Dealing with, and responding to you about a comment or complaint submitted via an online form or if you have requested to download content from the site utilising online forms;

Facility ERP will not sell your data to any 3rd party. On occasion Facility ERP may share your data, under non-disclosure, with other parties who work with us for the purposes of market analysis.


Legal Issues

We may disclose, but are not obliged to disclose, your personal information if required to do so by law or order of the court or if we believe that such action is necessary to prevent fraud or cyber crime or for the purpose of, or in connection with, any legal proceedings (including prospective legal proceedings) or for the purposes of obtaining legal advice or to protect us, our affiliates, our website or the rights (including the rights of privacy, confidentiality and reputation), property or personal safety of any person or otherwise in accordance with the Data Protection Act.

Facility ERP Expenses Policy 

 - Overnight stays are necessary if otherwise a Consultant would need to leave home before 7am and/or arrive home after 8pm, or where it is economic to stay over, or unreasonable to travel home.

 - Interstate visits always require overnight stays and are charged at a full day’s rate.

 - Breakfast up to $15, Evening Meal up to $25 when staying away.

 - Additional daily charges such as parking, kilometres and tolls will be recharged to clients unless otherwise agreed.

  • Organisation is the company that has purchased our Services for which you work


Application Users

The purpose for using your personal data is to provide the Service to your Organisation. When we use your personal data to allow you to access and use FacilityOnline, we do so on the instructions of your organisation and on behalf of your organisation. This makes us a "data processor" for the purposes of the Data Protection Legislation. However, there may be certain circumstances under which we use your personal data for purposes that are not on behalf of your organisation or in accordance with instructions of your organisation, for example, where we need to use it for our own purposes. Under these circumstances, we are a "data controller" for the purposes of the Data Protection Legislation. Please see ("How do we use your personal data") for more information.

Former Application User

We may retain your personal data to maintain a limited version of your business account profile and for our own purposes, for example, where we wish to offer you services which we think you may be interested in. This makes us a "data controller" for the purposes of the Data Protection Leg

What do we collect?

Application Users

We need to use personal data about you in the course of providing the Service to your organisation and for ancillary purposes set out in this Privacy Policy. Depending on the relevant circumstances and requirements, we may collect some or all of the personal data listed below to help us with this: 

Name; phone numbers; Date of Birth; Gender; Email address; Home address; Photo; Employment Type, Tax File Number, Payroll Number, Leave Balances, Log data from your devices including locations, start and finish times and photo’s during the clock in process

As a former application user the above information will also be retained.

  • Entered by you into our system


How do we use your personal data?

Application Users

The purpose for using your personal data is to provide the Service to your organisation. When we use your personal data to allow you to access and use our services, we do so on the instructions of your organisation and on the behalf of your organisation. This makes us a "data processor" for the purposes of the Data Protection Legislation. Activities that we may carry out on this basis include: Allowing you to access and use the Application; Providing you with assistance (including technical assistance) in relation to your use of the Application; Personalising and optimising your experience of the Application and providing you with software updates; and ensuring compliance with the terms of our agreement with your organisation. 


However, there may be certain circumstances under which we use your personal data for purposes that are not on behalf of your organisation or in accordance with instructions of your organisation. Under these circumstances, we are a "data controller" for the purposes of the Data Protection Legislation. Activities that we may carry out on this basis include making announcements to you regarding our products and service offerings


How long will we keep your data for?

We will not keep your personal data for longer than we are permitted to do so under our agreement with your organisation or as is necessary for the purposes for which we have collected it unless we believe that the law or other regulation requires us to preserve it (for example, because of a request by a tax authority or in connection with any anticipated litigation) or if we require it to enforce our agreements.

Access and rights you have to your information

You have various rights in relation to the personal data that we hold about you. To get in touch about these rights, please contact us or your organisation.


If you are an Application User and you wish to make a request in relation to our use of your personal data for the purposes of providing the Service to your organisation (and in respect of which we are a data processor), please contact your organisation in the first instance to handle your request. If you contact us, we will refer your request to your organisation. 


If you are an Application User and you wish to make a request in relation to our use of your personal data which is unconnected to your organisation or you are a Former Application User or a Website User, please contact us and we will handle your request. 


The Data Protection Legislation gives you the following rights in relation to your personal data: 


  • Right to object: this right enables you to object to us processing your personal data 

  • Right to withdraw consent: Where we have obtained your consent to process your personal data for certain activities (for example, sharing your information with a third party application), you may withdraw this consent at any time and we will cease to carry out that particular activity that you previously consented to unless we consider that there is an alternative legal basis to justify our continued processing of your personal data for this purpose, in which case we will inform you of this condition. 

  • Data Subject Access Requests (DSAR): You may ask us to confirm what information we hold about you at any time, and request us to modify, update or delete such information. You may also request a copy of the information we hold about you. 

  • Right to erasure: You have the right to request that we "erase" your personal data in certain circumstances. We will try to delete your personal data quickly upon request and if desired make it available to you. While we will endeavour to permanently erase or return your personal data upon request, some of your personal data may still exist within our systems, for example if it is waiting to be overwritten. For our purposes, this personal data has been put beyond use, meaning that, while it still exists in the electronic ether, our employees will not have any access to it or use it again. We may retain and use your personal data if we believe that the law or other regulation requires us to preserve it (for example, because of a request by a tax authority or in connection with any anticipated litigation) or if we require it to enforce our agreements. If you are an Application User connected with an organisation, we shall not delete or edit your personal data without the approval of your organisation.

  • Right to restrict processing: You have the right to request that we restrict our processing of your personal data in certain circumstances, for example if you dispute the accuracy of the personal data that we hold about you or you object to our processing of your personal data for our legitimate interests. If we have shared your personal data with third parties, we will notify them about the restricted processing unless this is impossible or involves disproportionate effort. We will, of course, notify you before lifting any restriction on processing your personal data. 

  • Right to rectification: You also have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you, including by means of providing a supplementary statement. If we have shared this personal data with third parties, we will notify them about the rectification unless this is impossible or involves disproportionate effort. You may also request details of the third parties that we have disclosed the inaccurate or incomplete personal data to. Where we think that it is reasonable for us not to comply with your request, we will explain our reasons for this decision. 

  • Right of data portability: If you wish, you have the right to request that we transfer your personal data to another third party. To allow you to do so, we will provide you with your personal data in a commonly used machine-readable format so that you can transfer the data. Alternatively, we may directly transfer the personal data for you. This right of data portability only applies to certain types of personal data. 

  • Right to lodge a complaint with a supervisory authority: You also have the right to lodge a complaint with the relevant supervisory authority in your jurisdiction.
